Terms & Conditions - the basics

These Terms and Conditions (“Terms”) govern your use of the Lume Tan Lounge website, mobile application, and 24/7 self-service tanning facilities (“Services”). By using our Services, you agree to these Terms. If you do not agree, you must not use the Services.

About Us

Lume Tan Lounge (ABN 856 0991 0114) provides automated, self-service spray tanning services in Tasmania, Australia.

Governing Law

These Terms are governed by the laws of Tasmania, Australia. You agree that any disputes will be subject to the jurisdiction of the courts of Tasmania.

Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law.  Where services are not supplied with due care and skill, you may be entitled to remedies under the law.
To the extent permitted by law, our liability is limited to:

  • Re-supplying the services; or 

  • Paying the cost of having the services supplied again 

24/7 Unattended Facility

Lume Tan Lounge operates as an unmanned, self-service facility. By entering and using the premises, you acknowledge that:

  • No staff are present on-site at all times 

  • You use the premises at your own risk 

  • You are responsible for your personal safety and conduct 

Conditions of Use and Misuse

  • One session = one (1) machine cycle within your allocated booking time 

  • Access is limited to one person per session, unless prior approval is granted. If you are found to have used more than the services paid for at the time of booking, these additional services will be automatically charged to your card.

  • Misuse, damage, or failure to follow instructions may result in: 

  • Additional session charges 

    • Cleaning fees 

    • A $150 misuse fee 

    • Suspension or termination of access 

Safety & Assumption of Risk

You acknowledge that spray tanning involves inherent risks, including:

  • Skin reactions 

  • Allergies 

  • Uneven outcomes 

You confirm that:

  • You have completed the Spray Tan Consent Form 

  • You have considered any medical or skin conditions 

  • You will follow all instructions provided 

To the extent permitted by law, Lume Tan Lounge is not liable for:

  • Misuse of equipment 

  • Failure to follow instructions 

  • Pre-existing conditions 

Health & Hygiene Requirements

You agree to:

  • Attend your session clean and prepared as per pre-care instructions 

  • Follow hygiene expectations within the facility 

  • Leave the room in a clean condition 

  • Failure to comply may result in cleaning charges.

Registration & Account Security

You must provide accurate information when creating an account.
You are responsible for:

  • Maintaining confidentiality of your login details 

  • All activity under your account 

  • Not sharing access codes or entry permissions 

  • Notify us immediately of any unauthorised use of your password, account or security breach.

Unauthorised sharing may result in suspension.

Eligibility

You must:

  • Be at least 18 years old (or have guardian consent where permitted) 

  • Be legally able to enter into a contract 

  • Complete the required consent documentation

Payments

Payments are processed via third-party providers (Ezidebit & Stripe – The “Payment Processor”). You agree to be bound by the Payment Processors terms and conditions available on their website. You're responsible for any fees associated with declined payments.  You can pay for services using Credit Card, Debit Card, Apple or Google pay etc
You agree:

  • To pay all fees at the time of booking 

  • That pricing may change at any time 

  • That failed payments may incur additional fees 

Refund Policy

We do not provide refunds except where required under the Australian Consumer Law. If you experience an issue with our services, we encourage you to contact us directly at hello@lumetanlounge.com.au or via phone at 0456585148. We are committed to resolving any concerns promptly and may, at our discretion, offer alternative solutions such as complimentary sessions or account credits in exceptional circumstances.
By proceeding with your booking or purchase, you acknowledge and agree to this refund policy. At our discretion, we may offer:

  • Credits 

  • Replacement sessions 

Membership Terms

At Lume Tan Lounge, we value your membership and aim to provide you with the best tanning experience. However, we understand that circumstances may arise where you need to cancel your membership.

  • Cancellation Notice

    • Memberships can be cancelled at any time from your Tan Club account ONCE you have fulfilled your minimum term. Cancellations will take effect at the end of the current billing cycle.

  • No Refunds

    • We do not offer refunds for any unused weeks or portions of your membership, including situations where you have not utilised your memberships spray tans.

  • Access After Cancellation

    • Once your membership is cancelled, you will no longer have access to membership benefits, including weekly spray tans, discounted rates, or any other perks associated with the membership.

  • Reactivation

    • If you wish to rejoin after cancelling, you may sign up for a new membership through our app or by contacting us directly.

Overdue Payments

We reserve the right to:

  • Suspend your account 

  • Recover outstanding amounts 

  • Engage debt recovery services 

All associated recovery costs may be passed on to you.

Premise & Safety Compliance

You agree to comply with:

  • All posted safety signage 

  • Emergency procedures 

  • Directions relating to safe use of the facility 

Our premises operate in accordance with applicable Tasmanian building and safety requirements, including accessibility obligations where applicable.

CCTV & Security

CCTV may be used in common areas for safety and security. No CCTV is applied in the private booth rooms.  By entering the premises, you consent to this monitoring in accordance with applicable privacy laws.

Privacy

We handle personal information in accordance with the Privacy Act 1988. Please refer to our Privacy Policy for further information.

Intellectual Property

All branding, content, and materials are owned by Lume Tan Lounge and protected by law.  Unauthorised use is prohibited.

Disclaimer

Services are provided “as is” and “as available.”  We exclude all warranties except those required by law.

Termination

To the extent permitted by law:

  • We are not liable for indirect or consequential loss 

  • Liability is limited to the resupply of services or cost thereof 

Limitation of Liability

We may suspend or terminate access if:

  • These Terms are breached 

  • Misuse occurs 

  • Required by law 

Indemnity

You agree to indemnify Lume Tan Lounge against claims arising from:

  • Your use of the Services 

  • Breach of these Terms 

Dispute Resolution

Disputes will be handled as follows:

  • Written notice provided 

  • 14-day good-faith negotiation 

  • Mediation in Tasmania (if required)
